Quality Consultation Service Terms and Conditions

Quality Consultation Service was founded in Honolulu, Hawaii.  We operate on the principles of good service at a fair price.  Feel free to reach us by phone at (808) 227-1372 or email at qualityconsultationservice@gmail.com.  Our building is located at 445 Seaside Ave, Honolulu, HI 96815.  However, it is a private residence.  Please call or email to make an appointment.  Submit a work ticket online through the Client Support Page.  Clients who do not may be charged at the hourly rate.

Otherwise, please take a minute to review our privacy policy.  In an effort to be as transparent as possible, please read the following terms and conditions.  Quality Consultation Service may also be referred to in these terms and conditions as QCS or QCS Hawaii. 

QCS Hawaii Website Services

Quality Consultation Service offers a free website audit for potential customers.  This is a standard virtual audit of your site.  Any additional, or special audits will be charged at our hourly rates.  Websites are a highly custom project and no two sites are the same.  In an effort for transparent prices and easy access for small business owners, we have featured our services as products in our web store.  
 

If you have a large project, or require extra customization, please Contact Us prior to checkout or Request a Quote in advance.  Upon checkout, you can expect to hear from us within 48 hours to start your project.  Since each web design service is different, we have separated their terms and conditions below.  

Web Design Terms and Conditions

Each Web Design project includes three total edits.  The first edit will be the overall layout and feel of the site.  After the site is completed, a rough draft will be submitted for your approval.  Any changes or requests you have can be submitted at this time.  After those changes are made you will give the final okay for your project, or suggest a last round of small adjustments to the final project.

Unless otherwise specified Quality Consultation Service owns complete rights to the created website.  However, as long as payment is current, we may release those rights to you.  Client shall retain any rights to pre-existing websites that QCS Hawaii edits.  Certain design elements may be specific to themes, plugins, and other outside vendors with their own policies, as well as terms and conditions.

Web Hosting Additional Information

We use WPMUDEV as our web hosting service.  So in addition to our terms and conditions, theirs apply as well.  We charge monthly for hosting.  The QCS website is set up to charge each month, as a subscription style service.  If for whatever reason you are unable to pay, you must reach out prior to the due date.  If your payment has not been received by the next month payment date, your hosting service will be cut off.  If after you fail your first payment, we try to contact you and receive no response, we reserve the right to shut the hosting down sooner.

We have an added a service fee to their hosting price.  You pay this for access to, and set up of the premium plug ins and services that come with this hosting.  This hosting service includes a @yourname.com email service for your company.  Please visit the WPMUDEV website or feel free to Contact QCS with any additional questions.

Website Management Information

Website management consists of updating themes and plugins.  Making sure that the site continues to run and operate smoothly.  The hours listed on the different pricing options are not dedicated blocks of time.  That is the reason we are able to offer such competitive monthly rates for management or hosting.  The basic package offers extremely occasional updates, like change of hours or phone number.  It does not include intricate customization. 
 
Apart from theme and plugin updates, if you make more frequent changes, we recommend the larger management package.  The larger management package does include more customization options and is more like dedicated blocks of time per week.  All management and edit requests shall be submitted online through the Submit Work Ticket page.  Clients who do not may be charged at the hourly rate. 

Website Audits Terms and Conditions

We offer a free website audit for any potential Web Design client.  It includes a speed test, and a variety of SEO tests.  There is no charge for this audit if clients do not purchase a website.  We do offer more thorough audits of web presence as well.  This website audit will include up to three competitors.  We will only use publicly available information on your competitors.  

All payments for this version of the website audits are final. 

Website Service Payments

All payments will be made directly through our online store.  If guests wish to arrange a different type of payment.  These payments may have their own terms and conditions. 
 
Subscription-style payments for web management and other services are automatically charged.  Customers must reach out prior to the billing date with any expected issues.  If done, they may be given a 30 day extension.  If customers do not reach out prior to payment issue, or it is not resolved in 30 days, this will result in the loss of all services.
 

Cancellation Policy

We reserve the right to use our discretion on refunds and cancellations regarding website services.  Each service and website is unique and will be evaluated on a case by case basis.

However, each party shall be as proactive and fourth coming as possible.  Cancellations shall be initiated at least 30 days prior to request.  Billing will continue during this time period.  If however, a quicker cancellation is deemed necessary by QCS Hawaii, we reserve the right to do so.

QCS Hawaii reserves all ownership rights unless formally relinquished in writing.

Quality Assurance Template Files

These template files are original documents.  Some have been inspired by other templates and documents.  However, those have all been recreated from scratch.  No template comes with file sharing rights to the original file.
 

Download and Technical Issues

If there are any technical issues with file downloads we will send replace the download.  Please reach out via the Submit Work Ticket page and we will resolve the issue.

Audits & Strategy Terms and Conditions

Virtual audits and live audits can cover a variety of topics.  Additional specific parameters may be set up in advance of any audit or strategy road map.  Any specific agreements shall over ride these basic policies.

Cancellation Policy

There is a 72 Hour cancellation period prior to any audit or strategy meeting.  Any completed hours will be billed accordingly.  QCS Hawaii owns all rights to any audit or strategy material until itʻs completion.

Legal Responsibility for Real Life Outcomes

While we have a background in compliance, you are responsible for your own business.  We recommend customers have lawyers, safety and human resource departments evaluate plans.  QCS Hawaii does not assume any legal liability for real life results of these services.

Audit & Strategy Ownership

Quality Consultation Service owns all Audit & Strategy work until the final payment on service has been made.  If service is not complete but payment is, customers own all finished results.  

However, if the service is complete prior to payment, QCS Hawaii has full ownership rights until resolution.

Sensitive Information and Competitive Advantages

All information gathered in any audit will be confidential.  We consider this term to be a blanket non disclosure for all clients.  However, if a client fails to pay completely, this specific term is null and void.  In that instance, an additional Non-Disclosure Agreement must have previously been signed.

Conflicts of Interest

Both sides shall do their best to avoid any conflict of interest.  Additionally, if at any point a conflict of interest arises it shall be reported to the other side immediately.  Undisclosed conflicts of interest may result in a cancellation of service.  

Service Quote Information

Quotes will be made according to our retail rates.  Please visit the online store for price information.  Any quote will be active for 30 days, after such time, QCS Hawaii may re-evaluate.

Free Quote Inclusions

Any free quote provided by Quality Consultation Service will be at our discretion.  If you would like to have a specific quote, please Submit a Ticket.

Client Support Ticket

All client requests shall be submitted via the Client Work Ticket page.  We reserve the right to charge at our hourly rate if this procedure isnʻt followed.  If you want an on call arrangement please Contact  Us for a custom rate.

Expected Timelines and Completion Dates

Each product or service that involves timeliness will have a guide on the product page.  QCS Hawaii reserves the right to amend these as necessary.  Any individual tasks or quotes may have specific timelines and agreements. 

Any extension of timeline by Quality Consultation Service will be accompanied by written explanation.  At this point guests maybe entitled to full or partial refund.

Privacy Policy

In addition, we have posted our privacy policy online for transparency. 

Dispute Resolution

Any dispute will first be attempted to resolve in good faith between the parties.  In the event of this failing, mediation shall be thought prior to legal action.  Any legal action shall take place according to Hawaii State Law.

Failure to Pay Terms and Conditions

Failure to pay will result in termination in service.  QCS Hawaii will retain all rights to any material not yet payed for.  We reserve the right to take legal and other actions for breach of contract.

Intellectual Property Ownership

Quality Consultation Service owns all rights to any intellectual property until fully paid for and released to client.

Release of Liability Terms and Conditions

Customers release Quality Consultation Service or QCS Hawaii from any and all legal liability regarding services rendered. 
 

Termination of Agreement and Separation 

Both parties have the right to terminate this agreement at anytime for any reason with 30 days advanced notice.
